The Citizens for Justice and Peace welcomes the partial victory by complainant Smt Zakia Ahsan Jafri (SLP-Crl   8989/2012        ) today when the Special Investigation Team (SIT) was compelled to give over 365 statements earlier withheld from her. The SIT tendered these documents in the Metropolitan  Magistrate”s Court after the Supreme Court had been seized of the matter (two hearings on December 3 and 10 respectively) and asked for an explanation from the SIT. (Attached is the December 10, 2012 Order of the Court and the earlier Order dated December 3, 2012).

The complainant Smt Jafri has pointed out in her special leave petition that incomplete supply of documents by the SIT amounted to a non-compliance of the September 12, 2011 order of the Supreme Court in SLP 1088/2008 as also inhibited her lawful right to file a comprehensive protest petition. The SIT had refused to give these documents while the matter had been argued before the Magistrate between May and July 2012. Finally the Magistrate too had not accepted the complainant’s plea compelling her to approach the Supreme Court for a clarification of the Order. Annexed as Annexure A is the list of documents today tendered by the SIT to the complainant.

The Supreme Court has placed the SLP for hearing before the larger special bench in the second week of January 2013. The earlier Investigation reports filed by SIT member AK Malhotra have also not been made available to the complainant Smt Jafri.
