Express news service : Ahmedabad, Sat Nov 03 2012, 07:05 hrs A victim and witness of 2002 Gulberg Society massacre on Friday filed an affidavit in the Gujarat High Court accusing the Supreme Court-appointed Special Investigation Team (SIT) of attempting to prevent evidence against senior police officers from being brought on record in the case.
The witness, Saira Sandhi, also urged the HC to dismiss the SIT petition in this regard.
According to details, following an application by Sandhi, the special trial court had directed SIT to submit before it relevant documents from its voluminous investigation report related to Zakia Jafri’s petition before the Supreme Court against CM Narendra Modi and others.
SIT had submitted the documents in two sealed covers while challenging the trial court’s order at HC on the ground that presenting the documents before the Gulberg court would give rise to two parallel judicial proceedings on the same sets of documents since the entire report on Zakia’s petition was still pending before the Ahmedabad Metropolitan Court for adjudication.
The HC has granted interim stay to SIT in the form of a direction that the sealed covers would not be opened by the trial court.
Sandhi has opposed the SIT petition and alleged that the SIT is preventing evidence of criminal negligence against senior police officers like M K Tandon and P B Gondia from coming out before the trial court.
According to Sandhi, the SIT report on Zakia Jafri’s petition has evidence to prove criminal negligence of these police officers.
The trial court is yet not decided on whether to arraign these police officers as accused in the case or not.
